Convertant Privacy Policy

This Privacy Policy describes the policies and procedures of Convertant LLC ( "we" or "us") on the collection, use and disclosure of your information at http://convertant.com (the "Site", collectively known as "Service") and the services, features, content or applications offered by this Service.

We and our associated service providers receive information in three ways: (i) through our customers ("Customers", direct recipients of our Service) who create an account (your "Account") and use the Service to manage and gain insight on marketing activities and (ii) any users who may engage with our customer engagement managers on your site and (iii) end users ("Users") who engage with our customer engagement manage or may click on any marketing assets (creatives, messages or content) ("Advertising") found on a variety of Customers' and third (who are not Customers or direct recipients of our Service) party sites that our Customers as part of their advertising effort use with the Service. We may also receive data from various sources, including: (iv) Customers who choose to share specific data with our service (v) from business partners ("Business Partners") websites and services. When you (Customers or Users) use the Services, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

What Does This Privacy Policy Cover?

This Privacy Policy covers the treatment of personally identifiable information ("Personal Information") gathered when Customers, Business Partners or Users are using or accessing the Services we provide. This Privacy Policy also covers our treatment of any Personal Information that Users, Customers and/or Business Partners may share with Convertant LLC or that We share with them. This Privacy Policy does not apply to the practices of third parties that Convertant LLC does not own or control or is in an agreement with, including but not limited to any third party websites, services and applications ("Third Party Services") that Customers elect to access or use in conjunction with the Service, such as Facebook, Twitter, any site where advertising based activities may occur, or to individuals that we do not manage or employ. While we attempt to facilitate access only to those Customers, Business Partners and Third Party Services that share our respect for User privacy, we cannot take responsibility for the content or privacy policies of these parties. We encourage our Customers and Users to carefully review the privacy policies of any Third Party Services you may access or use.

What Information Does Convertant LLC Collect?

The information we gather on behalf of our Customers and/or Business Partners enables us to personalize, improve and continue to operate the Services. In connection with certain aspects of the Services, we may request, collect and/or display some of your Personal Information. We collect the following types of information from our Users and Customers. Customer Account Sign-In Information: If applicable, when a Customer creates an Account, you will provide information that could be Personal Information, such as your username, password and email address. You acknowledge that this information may be personal to you, and by creating an account on our Service and providing Personal Information to us, you allow others, including Convertant LLC, to identify you and therefore may not be anonymous. We may use the contact information you provide us to send you information about our Services. You may unsubscribe from these messages by using the unsubscribe link found at the bottom of any emails you may receive from us., although we reserve the right to contact you when we believe it is necessary, such as for account recovery purposes.

URL Information:

One feature of the Services is the ability to create shortened uniform resource locators ("URLs"). We use this capability to collect and store both the original URL and the shortened URL and, if you have an Account and are logged in, associates that information with your Account. Convertant LLC also collects and stores (i) the time and date on which you shortened the original URL and (ii) if you chose to share the URL, information on the channels through which the URL was shared.

Metrics and Analytics:

On behalf of our Customers, we collect information about accesses (such as clicks and views) of every shortened URL created through our Services for use of Advertising measurement. This information includes, but is not limited to: (i) the IP address and physical location of the devices accessing the shortened URL; (ii) the referring websites or services; (iii) the time and date of each access; and (iv) information about sharing of the shortened URL on Third Party Services such as Twitter and Facebook (v). the use of technology or techniques to identify your browser and/or devices. These metrics and analytics are used by us, our Customers and Business Partners to measure marketing content effectiveness, path to purchase behavior and improve our Customers marketing activities and messaging in real time.

User Content:

Some features of the Services allow you to provide content to the Services, such as written descriptions of URLs, comments, images and video. All content submitted by you to the Services may be retained by Convertant LLC indefinitely, even after you terminate your account. We may continue to disclose such content to third parties in a manner that does not reveal Personal Information, as described in this Privacy Policy.

Information Shared With Us by Customers and/or Business Partners:

At their discretion some Customers may choose to share specific data with our Service to improve their insight and awareness of how their advertising assets, tactics or strategies are performing. Any information shared by Customers and/or Business Partners with our Service is subject to both the Customer's and our Privacy Policy, where the Customers and/or Business Partner's Privacy Policy overrides any policy we may have. Convertant LLC cannot be held responsible for any liabilities/accountabilities that the Customer and/or Business Partner's privacy policy may cause.

Information Collected From Third Party Services:

Some features of the Services allow you to share your Convertant LLC information with Third Party Cloud Based Services . If you choose to connect to any such Third Party Cloud Based Services, we may collect information related to your use of those Third Party Cloud Based Services, such as authentication tokens that allow us to connect to your Third Party Cloud Based Service accounts. We may otherwise collect information about how you are using the Services to interact with those connected Third Party Services. Note that Third Party Services may have the ability to restrict the information that is provided to us. 

IP Address Information and Other Information Collected Automatically:

We automatically receive and record information from Users' web browser and devices when they interact with the Services, including your IP address and cookie information. This information may be used to help our Customers understand how users interact with an Advertising and/or content unit, transit a (their) website, to fight spam/malware, to facilitate collection of data concerning your interaction with the Services and for other similar purposes.

Generally, the Services automatically collect usage information, such as the number and frequency of visitors to an Advertising and/or content unit. Customers may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. This type of aggregate data enables us, our Customers and third parties authorized by us to figure out how often individuals use parts of the Services so that we can analyze and improve them. 

Customer Email Communications:

We may receive a confirmation when you open an email from us. We use this confirmation to improve our customer service.

Information Collected Using Cookies or Browser "Finger Printing":

Cookies are pieces of text that may be provided to a Customers' or Users' computer through your web browser when you access a website. Your browser stores cookies in a manner associated with each website you visit. We use cookies to enable our Service to recognize your web browser and tell us how and when Customers and/or Users visit our Site and use the Services through the web.

Browser Finger Printing is collecting information from your browser and using this information to identify your specific browser.

Cookies and/or Browser Finger Printing allows us to track when a user has clicked on a Customer's Advertising asset that is associated with a Convertant LLC shortened URL. Each click of a shortened URL is tracked using a unique identifier assigned to the asset in one or more cookies/Browser Finger Printing identified by a users' web browser and associated with Convertant LLC.

Our cookies and/or Browser Finger Printing do not, by themselves, contain Personal Information, and we do not combine the general information collected through these capabilities with other Personal Information to tell us who a specific User is or may be. As noted, however, we do use these techniques to identify a User or Customer's web browser has accessed our Service and may associate that information with a Customer Account (if applicable) or Customers' Advertising asset.

Most browsers have an option for turning off the cookie feature, which will prevent a User's or Customer's browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend you leave cookies active, because they enable you to take advantage of the most attractive features of the Services.

Customers may also ask us not to place cookies on their web browser or use Browser Finger Printing when logged in. When cookies and/or Browser Finger Printing are disabled in this manner, clicks on Convertant LLC are not tied back to or associated with your web browser. Users may also request us to not place cookies on their web browsers or use Browser Finger Printing when viewing or clicking on Customer's Advertising Assets associated with the Convertant LLC Service. When cookies and/or Browser Finger Printing are disabled in this manner, clicks and views of these assets are not tied back to or associated with the cookies or your Browser. This Privacy Policy covers the use of cookies and Browser Finger Printing by our Service only and does not cover the use of cookies by third parties. We have no control when or how third parties place cookies or uses Browser Finger Printing on your computer. For example, third party websites to which a URL points may set cookies on your computer.

Aggregate Information:

We collect statistical information about how both Customers and Users, collectively, use the Services ("Aggregate Information"). Some of this information is derived from Personal Information, such as your location (which, in turn, is derived from your IP address). User statistical information is not Personal Information and cannot be tied back to a specific user or individual. Customer statistical information is not Personal Information, but may be connected to a specific Customer Account.

How and To Whom Is Customer And/Or User Information Shared

The Services are designed to help our Customers gain a better understanding of how their Advertising Assets are performing. As a result, much of the information generated through the Services is a result of our Customers using the service to better understand how Users are viewing and reacting to any Advertising Assets they make available.

IP Address Information:

While we collect and store User IP address information, that information is not made public. We do, however, make this anonymized information available, through our Site and Service to our Customers, service providers and other persons with whom we may conduct business. We may share hashes of User's IP address with other third parties, but these hashes cannot feasibly be reversed into the IP addresses themselves or linked to Users individually.

Aggregate Customer and User Information:

The information we collect is anonymous and non-identifiable and we share only Aggregate Customer and User Information that is collected by the Service with other Customers and Business Partners of our service and other persons with whom we conduct business, in order for them to do product development, marketing optimization and research, and other kinds of services. We share this kind of anonymous statistical data so that our Customers and/or Business Partners can understand how and how often people use our Services and their services or websites, which facilitates improving their services and online marketing, and how Convertant LLC interfaces with them.

Customer Email Communications with Convertant LLC:

As part of the Services, Customers may occasionally receive email and other communication from us relating to the Customer's Account. These emails will only be sent for purposes important to the Services, such as password recovery.

Information Shared with Agents of Convertant LLC:

We employ and contract with Business Partners and other entities that perform certain tasks on our behalf and who are under our control (our "Agents"). We may need to share Personal Information with our Agents in order to provide products or services to you. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information with our Agents.

Information Disclosed Pursuant to Business Transfers:

Information about user behavior is business asset. Moreover, if Convertant LLC, or substantially all of its assets, were acquired, or in the unlikely event that Convertant LLC goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Convertant LLC may continue to use your Personal Information as set forth in this policy.

Information Disclosed for the Protection of Convertant LLC and Others:

We reserve the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Service, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Convertant LLC, its Customers, Users and the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

Information We Share With Your Consent:

Except as set forth above, you will be notified when your Personal Information may be shared with third parties, and will be able to prevent the sharing of this information.

Is Information About Customers or Users Secure?

For Customers of our Service, your Account information is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account. We endeavor to protect Account information to ensure that it is kept private; however, we cannot guarantee the security of any Account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of Customer information at any time.

For users, we collect no personal information, only anonymized behavioral data. This data is stored in the same fashion, using the same security used for our Customer accounts. We store all of information, including IP address information, using industry-standard security techniques. However, we not guarantee or warrant that such techniques will prevent unauthorized access to information about Customers Accounts stored by Convertant LLC, Personal Information or otherwise.

If I am a Customer what Information of Mine Can I Access?

If you are a Customer, you can access information associated with your Customer Account by logging into the Site. This information includes a history of the URLs you have shortened, and access to the metrics pages for those URLs.

If I am a User what Information of Mine Can I Access?

Given User data is strictly anonymized and not associated/registered with a specific User account (since we do not offer one for Users) we cannot provide users metrics on their usage.

How Can a Customer Delete Their Account?

In the interest of ensuring that existing Convertant LLC links continue to function for Customer's Advertising Assets, Convertant LLC short links currently cannot be deleted or disabled. As such, any Advertising Assets or Activities that have already occurred on your account currently cannot be deleted.

What Choices Do I Have Regarding My Information?

As stated previously, you can always opt not to disclose certain information to Convertant LLC, even though it may be needed to take advantage of some Convertant LLC features.

You can delete your Account. Please note that Convertant LLC will need to verify that you have the authority to delete the Account, and activity generated prior to deletion will remain stored by Convertant LLC and may be publicly accessible.

What Happens When There Are Changes to this Privacy Policy?

We may amend this Privacy Policy from time to time. Use of information about user's and their viewing and/or interaction with any Customer Advertising Assets we collect either directly or on behalf of our Customers now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we collect or use information, we will notify Customers and/or Users by posting an announcement on the Services or sending Customers an email. Customers are bound by any changes to the Privacy Policy when he or she uses the Services after such changes have been first posted.
